Guarantee of proper functioning: a new protection for consumers

Starting October 5th, 2026, a new warranty of proper functioning will come into effect in Quebec for several new appliances. This protection will be in addition to the legal warranties already provided by the Consumer Protection Act.

It will cover, among other things, stoves, refrigerators, freezers, air conditioners, and heat pumps for six years. Washers, dryers, and dishwashers will be covered for five years, televisions for four years, and computers, cell phones, tablets, and game consoles for three years.

The warranty will be automatic and free. In the event of a problem during the warranty period, the retailer or manufacturer will be responsible for the repair, including parts and labor.

According to Protégez-Vous, some retailers expect a price increase for certain products, while consumer advocacy groups believe the warranty periods are too short.

And contrary to what one might think, this new guarantee does not replace the reasonable duration guarantee: the latter can still be invoked during and even after the period of proper functioning guarantee.
